Nearella Terms of Service
§ 1. General provisions
The Nearella website (the Service) is run by [uzupełnić: nazwa firmy z CEIDG] — [uzupełnić: imię i nazwisko], [uzupełnić: adres wykonywania działalności], NIP [uzupełnić: NIP], REGON [uzupełnić: REGON] (the Provider). Contact with the Provider: [uzupełnić: e-mail kontaktowy]. This address is also the point of contact for users and for the authorities of the Member States and the European Commission under Articles 11 and 12 of Regulation (EU) 2022/2065 on a Single Market for Digital Services (the DSA). We correspond in Polish and in English. Terms used here: User — a person using the Service, with or without an account; Account — a User’s account in the Service, created at the first sign-in; Coach — a User who keeps a coach profile in the Service; Club — a User who keeps a profile of a club, school or other training venue; Profile — the public page of a Coach or a Club in the Service with its data; Request — a message a User sends through the Service to a Coach or a Club to arrange training; Consumer — a User who is a consumer within the meaning of Article 22¹ of the Polish Civil Code.
These Terms are available free of charge in the Service in a form that can be downloaded, saved and printed.
§ 2. Services
The Provider offers the following services by electronic means: browsing the map, lists and Profiles of Coaches and Clubs and the sport pages — without an account; keeping an Account; sending Requests to Coaches and Clubs and following their status; marking that a User trains with a given Coach (“I train here”) and the Coach’s confirmation of it; for Coaches and Clubs: creating and publishing a Profile, receiving Requests, Profile statistics, and linking the Profiles of Coaches and the Clubs where they teach.
The services are free of charge. Paid services (such as Nearella Pro) may be introduced in the future, only through an amendment of these Terms or separate conditions accepted before ordering them. The Service helps people get in touch. The User agrees the training, its terms, price and payment directly with the Coach or the Club. The Provider is not a party to that agreement and does not handle payments. Where a Coach or a Club acts as a trader, the Consumer’s rights under that agreement are exercised against them. The agreement for browsing the Service is concluded when the Service is opened and ends when it is left. The agreement for keeping an Account is described in § 4.
§ 3. Technical requirements and security
Using the Service requires a device with internet access and an up-to-date web browser (such as Chrome, Safari, Firefox or Edge) with JavaScript and browser storage enabled; signing in requires a Google account or an e-mail address. “Near me” uses the device’s location only if the User allows it; distances are calculated in the browser. Using services by electronic means involves common risks such as malware, phishing or a taken-over mailbox. Signing in to the Service needs no password: it works through Google or a one-time link sent by e-mail. Do not share that link with anyone.
§ 4. Account
An Account is created at the first sign-in — with a Google account or through a link sent to the e-mail address given. At that moment an agreement for keeping the Account is concluded for an indefinite period. An Account may be created by a person aged 16 or older. A Request on behalf of a younger person is sent by their parent or guardian from their own Account. The User gives true data, uses one Account and does not share it with others. The User may end the agreement at any time by deleting the Account in the account settings. Deleting the Account also deletes the User’s Requests, Profiles and “I train here” marks — see the Privacy Policy. The Provider may block an Account or end the agreement for good reasons: a breach of these Terms or of the law, false data, spam or unlawful content. The Provider informs the User of the decision and its reasons at the Account’s e-mail address. For Coaches and Clubs acting as traders, notice is given 30 days in advance, unless the law allows ending the agreement without notice, in particular after a serious or repeated breach of these Terms.
§ 5. Profiles of Coaches and Clubs
A Coach or a Club creates a Profile in the Account: they give, among other things, their name, sports, a description, photos, training places, prices, languages and contact details, and then send the Profile for approval. The Coach or the Club declares that the Profile data are true and that they may publish them, and that they hold the copyright in the photos or the consent of their owner and of the people shown. A Club also declares that it runs the club or may represent it. Before publication the Provider checks the Profile, usually within 1–2 working days. It may refuse publication if the Profile breaches these Terms or the law or is incomplete; it then gives the reason, and the Coach or the Club may correct the Profile and send it again. Changing the name or the sports of a published Profile requires a new approval; other changes show at once. The Provider may prepare and publish a Profile for a Coach who has agreed to it (for example in a message or by e-mail); the consent is recorded. The Coach may take over such a Profile through an invitation link or ask for its removal at any time. A published Profile is public: everyone visiting the Service sees it, and it may appear in search engine results and in link previews in messaging apps. The e-mail address and phone number for Request notifications are not public. The Coach or the Club grants the Provider a free, non-exclusive licence to display the Profile content (texts and photos) in the Service, to the extent needed to run it, for as long as the Profile is published. The Provider may process photos technically: change their format and size, crop thumbnails and remove metadata (such as GPS location). In the free version a Profile may have up to 3 photos. A Coach or a Club ends the publication of a Profile by deleting the Account or by asking the Provider to hide or remove the Profile. A Coach and a Club may link their Profiles: the Club invites the Coach or the Coach asks the Club to join. The link is public once the other side accepts it; either side may end it.
§ 6. Requests
A signed-in User may send a Request through the form on a Profile. The Request contains the name, the sport and — if the User gives them — convenient times, a message, a phone number and a Telegram username. The reply comes to the Account’s e-mail address or to the contact given. By sending a Request, the User agrees that the data from the form are passed to the chosen Coach or Club. The Request goes to that recipient only. One Account may send at most 5 Requests a day and one Request a day to the same Profile. The Coach or the Club uses the data from a Request only to reply and arrange training, and is their separate controller from the moment of receiving them. They may not use them for advertising or pass them to anyone else. The status of a Request (such as “Read” or “In touch”) is set by the Coach or the Club. The Provider does not guarantee that the recipient replies.
§ 7. Order of results
The map and the list show published Profiles in the chosen city. The User may narrow them with filters such as sport, type of Profile (coach or club), language, level, format, price, distance and travelling to the client. When the User turns on location (“Near me”), the results are ordered from the nearest. Without location, Profiles marked “Founding coach” (the first Coaches who joined the Service) come first and the rest follow alphabetically. The “Similar coaches” section of a Profile shows up to three Coaches from the same city who teach at least one of the same sports, nearest first. The Provider takes no payment for a higher position in the results.
§ 8. Prohibited content and notices
Users may not provide unlawful content, in particular content infringing personal rights, copyright or data protection law, nor offensive or misleading content, advertising unrelated to sports training, or spam. Anyone may report content they consider unlawful or contrary to these Terms by writing to [uzupełnić: e-mail kontaktowy]. The notice should explain why the content is not allowed and include the link to the page, the name and e-mail of the person reporting (unless it concerns certain offences against children) and a statement that the notice is made in good faith (Article 16 DSA). The Provider handles notices without undue delay, confirms their receipt and informs the person reporting of the decision. If the Provider removes content, hides a Profile, refuses publication or blocks an Account, it gives the User a statement of reasons (Article 17 DSA). The decision may be appealed by writing to [uzupełnić: e-mail kontaktowy]. The Provider does not monitor content on an ongoing basis but checks Profiles before publication.
§ 9. Liability
The Provider takes care that the Service works without interruption but may limit its availability for technical reasons, including maintenance and updates. The information in Profiles (such as qualifications, prices and times) comes from Coaches and Clubs. The Provider checks Profiles before publication but does not verify qualifications and is not responsible for the quality of training or for the performance of agreements between Users and Coaches or Clubs. Points 1–2 do not limit liability towards Consumers to the extent the law does not allow it to be limited.
§ 10. Complaints
Complaints about how the Service works may be sent to [uzupełnić: e-mail kontaktowy]. Please include the Account’s e-mail address, a description of the problem and, if possible, a link to the page. The Provider replies to a complaint within 14 days of receiving it, to the address it came from. A Consumer may use out-of-court ways of resolving disputes, for example the help of a municipal or district consumer ombudsman (rzecznik konsumentów) or of the regional Trade Inspection. More information: uokik.gov.pl.
§ 11. Personal data
The controller of Users’ personal data is the Provider. How data are processed, Users’ rights and cookies are described in the Privacy Policy.
§ 12. Changes to these Terms
The Provider may change these Terms for good reasons, in particular a change of the law, of the scope or manner of the services, or of security requirements. The Provider announces a change at least 15 days before it takes effect — at the Account’s e-mail address and with a notice in the Service. A User who does not accept the change may delete the Account before that day. Changes do not affect Requests sent before they take effect.
§ 13. Final provisions
These Terms are governed by Polish law. This choice of law does not deprive a Consumer of the protection of the mandatory provisions of the country of their habitual residence. Disputes with Consumers are settled by the courts competent under the general rules. These Terms apply from October 27, 2026. The Polish version prevails.
